Microsoft and Sony have indicated that they are not obliged to pass the tariff refunds from the U.S. government directly to consumers. Nintendo expressed similar sentiments earlier this summer.
At a time when gaming is becoming more expensive than it has been in over two decades, the XBOX and PlayStation parent companies aren’t looking to utilize the tariff refunds to ease the stress on consumers’ wallets. Instead, attorneys are arguing that they don’t need to help consumers who voluntarily paid an advertised price for a product.
Gaming Giants Say Consumers Aren’t Entitled to Tariff Refunds
The latest updates come from Game File, where Stephen Totillo shares new comments from Sony’s lawyers in a legal filing asking a judge in California to dismiss a potential class action lawsuit over the tariff refunds.
“Paying fair market price for voluntarily purchased consumer goods is not a legally cognizable injury in fact,” the lawyers wrote.
Microsoft’s lawyers made a similar statement in late August regarding dismissing a potential class action lawsuit.
“There is nothing unjust about Plaintiff purchasing an Xbox at an advertised price and getting exactly what he paid for—regardless of whatever theory he devised months later about Microsoft’s cost structure.”
Back in July, Nintendo attorneys said the same, arguing, “Those who bought Nintendo’s products received exactly what they bargained and paid for: a console, game and/or accessory at a price to which both parties agreed.”
In March, Nintendo sued the United States government over President Donald Trump’s tariff policy.
All major game consoles have seen price increases due to a combination of tariff issues and memory shortages. Recently, Sony has faced additional legal action over accusations that it is trying to monopolize the video game market by unfairly controlling the PlayStation digital storefront.
