Nintendo will receive $2 million in a new settlement from a Switch Modder. He has also received a permanent injunction preventing them from selling modded devices again.
Nintendo filed a lawsuit against Ryan Daly, the owner of Modded Hardware, in July 2024, claiming that he was selling different types of hardware that allowed players to install pirated games in their Switch. Nintendo had asked Daly to stop selling modded hardware, or he would be sued, and Daly refused to do so. Now, that case has been finally settled.
Nintendo Switch Modder To Pay $2 Million in Settlement
According to a report by VGC, the 2024 case has been finally settled, with Switch modder Daly having to pay $2 million in settlement. The settlement also imposes a permanent injunction on Daly, which will prevent him from selling devices that can mod consoles, modded consoles, or providing any documentation or information on how to install mods.
The lawsuit also claims that Daly not only helped his customers with modded Switch consoles and installed mods, but also provided them with pirated games. The lawsuit stated that Daly “preinstalls on the console a portfolio of ready-to-play pirated games, including some of Nintendo’s most popular titles such as its Super Mario, The Legend of Zelda, and Metroid games.”
For those unaware, Nintendo had first warned Daly that if he didn’t stop selling these modded Switch consoles, they would sue him. As he refused to listen, Nintendo went to a federal court in Seattle to file a complaint, which accused Daly of “trafficking in circumvention devices” and copyright infringement. Daly initially denied any wrongdoing; however, he ultimately settled for the amount mentioned above.
